NFA Gun Trust Form

Due to high demand with the current state of Virginia’s firearms laws, we require a $150 consultation fee to reserve your 15-minute firearms consultation. This amount will be credited towards the creation or modification of your trust, or any of your related legal needs if you retain our services. It is more important than ever that Virginians protect their Constitutional Rights and we want to ensure we can provide the careful attention each of our clients deserve.

Instructions

The trust can be named whatever you like, but it should be unique, short, and the last word must be “Trust.”

If you do not have a specific name in mind, use something like your initials or family name followed by “Firearms Trust.” For instance, we could have the “Welch Wright Firearms Trust.”

PLEASE NOTE: If you plan to build or manufacture NFA items, the trust name must be engraved on the item. Keep that in mind when naming your trust, if you have any intention of building any items or modifying existing items that would place them under the NFA (like modifying an existing rifle into an SBR). This is specific to new NFA items. You do not need to engrave existing NFA items that are transferred into the trust.

Your “Co-Trustees” are the people you would like to be able to access your NFA Items outside your presence. However, your Co-Trustees CANNOT be a prohibited person. It is still your responsibility to ensure that anyone named as a Trustee is not prohibited from possessing firearms under federal, state, or local law. You also cannot have anyone under the age of 18 serve as Trustee.

PLEASE NOTE: Your Co-Trustees will be considered “Responsible Persons.” So, any time new NFA items are transferred into the trust, they must also complete the duplicate Form 23, fingerprint cards, photos, etc. However, ATF also provides the following guidance on their eForms FAQs: “No documentation is required to be submitted to ATF when a new responsible person is added to a trust or legal entity. However, should a responsible person change while a Form is in pending status (before final disposition) the applicant or transferee must contact the NFA Division for guidance.”: If you are not sure about whether you want to add someone yet, leave this field blank. You can still add Co-Trustees after NFA items have already been transferred into your trust.

Beneficiaries are the people you want to inherit the items in your trust when you pass away. 

You can include children under the age of 18 here, just make sure to clearly identify they are currently under the age of 18. The items can be held in trust by your other Trustees until your children or grandchildren are old enough to possess the NFA items.

To create a valid trust, you have to “fund” the trust as soon as it is created. This does not have to be something substantial, but it’s usually best to set aside something valued around $10 - $100.

Most people find it easiest to set aside a $10 or $20 bill and a small quantity of ammunition, either a box or a single cartridge.

Enter whatever you will specifically be setting aside as the initial trust property. Place that in a separate envelope, container, safe, etc. Whatever you place it in, be sure to CLEARLY LABEL the container with the name of your trust.

You can amend your trust later to remove the initial property (just like you can add additional property), but that is why it is generally best to set something small aside that you can just leave in your safe or other secure storage location along with the rest of your trust property.
